Divorce for Expats & Diaspora

I married a Moroccan and want a divorce — which country do I file in?

You may genuinely have a choice of two courts, and they do not produce the same outcome on children, maintenance or the home. Choose deliberately, and remember that whichever you choose will still have to be made to count in the other country.

You probably have a choice. Make it on purpose

Moroccan courts can take jurisdiction over personal status and the dissolution of marriage even against a spouse who is neither domiciled nor resident in Morocco. Your own courts may also have jurisdiction, on residence or nationality. So two doors are often open, and the common mistake is to walk through whichever is nearer rather than whichever is better.

Morocco replaced its entire Code of Civil Procedure with Law 58.25, in force since 24 August 2026. Jurisdiction and the recognition of foreign judgments both changed. Anything written before that date may describe rules that no longer apply — ask any lawyer you speak to how they are handling it.

What actually differs between the two

Children. Moroccan law separates custody (hadana, who the child lives with) from guardianship (wilaya, legal authority, which in practice controls travel documents). A foreign court will not make that split. If the children are in Morocco, or may be taken there, this is the single biggest reason to think hard about forum.

Money. A Moroccan court fixes the financial consequences before the divorce takes effect — maintenance for the children, maintenance for the wife during the waiting period, housing of the custodial parent, and compensation. What does not happen is the automatic equal division of assets that clients from common-law countries expect. If most of the matrimonial wealth is in your own country, that difference may matter more than anything else here.

Speed. A Moroccan divorce for irreconcilable discord (chiqaq) must be decided at first instance within six months of filing. That is a real statutory ceiling, and it is faster than many foreign contested divorces — though it does not cover appeals, service abroad, or enforcement.

The catch, whichever you choose

A judgment is only a judgment where it was given. A Moroccan divorce may need recognising at home; a foreign divorce needs exequatur in Morocco before Moroccan records change. Under Law 58.25 the conditions include the foreign court's competence, due process, finality, no conflict with an earlier Moroccan judgment, public policy, and — new — reciprocity.

The United Kingdom and the United States have no bilateral convention with Morocco on personal status. France, Belgium and Spain do. If you hold a British or American passport, that is worth establishing before you choose, because the recognition step is the one that bites later.

The mistake that doubles the cost

Filing in both countries at once. It happens constantly: each spouse opens proceedings on their own side, each hoping their court rules first.

This is the worst available outcome. It costs twice, takes longer, and produces two judgments where the second risks colliding with the first — and conflict with an earlier judgment is itself a ground to refuse recognition. If proceedings have already been started anywhere, say so in your first sentence.

What to tell us first

This page states the law as we checked it on 25 October 2026. Moroccan family and procedural law is under active reform, so check anything here against the position on the day it matters to you. Any figures are typical ranges, not a quote.
